2: The Sentence

During the next week Draco could not seem to tear his mind from Harry touching him that way. He wanted to scream and yell but he could not find the strength. Nothing but the sorrow accompanied him now. The cell he was thrown into last week is dark and damp. The walls bore the markings of previous occupants, and it smelled as if something died here. ‘No doubt that it’s true.’ All the walls and doors were set with magical wards to keep nothing from going in or out. The only way to enter is in the hands of a Dementor.

A chill ran up Draco’s spine as he remembered the Dementor’s touch. All the warmth seemed to be sucked out of him and a freezing chill sunk into his bones. He felt like we would die just from the touch. He couldn’t imagine what a kiss would feel like… He shook his head and stopped that line of thought right there.

The remaining clothes he wore were now pitifully ruined and dirty. His normally sleek platinum blonde hair now hung around his head unkempt. What was the point in looking good when no one would see you ever again? He still bore the marks from the battle, bruises here and there and a few cuts that have healed over.

There was a quiet shuffling noise outside his cell. Draco’s heart leapt into his throat as fear took over. The magic wards slid away, revealing a Dementor coming towards him. When it seized his arm he instantly felt the remaining warmth drain away. It dragged him to the top most part of Azkaban where a few Aurors awaited his presence. They bound him in magic chains and drug him to the apparition point.

“What is going on?” Draco’s voice came out in a cracked unused manner.

“It’s time for your trial, boy…” One with a long pointed face and sharp blue eyes said.

When Draco was escorted into the court room his heart stopped. The Entire Wizengamot was here to observe the proceedings. The Minister of magic, Rufus Scrimgeour, seemed to be the judge. Draco looked at all the faces of witches and wizards that would determine his future. The Auror with the long pointed face dragged him to a small dais in the center of the coliseum like room. Draco was forced onto his knees none to kindly, where the shackles sprang to life and attached to his wrists and ankles. He had about a foot of slack so he could sit upright on his knees, but no more.

The sweat of fear trickled down his back as tears threatened to escape. He shook violently as the witches and wizards ended their conversations and peered down their noses at him as if he were filth. Scrimgeour dug into the many stacks of paper around him until it seemed her found the one he was looking for. Examining its contents for a few moments a slow grin spread across his lion like features.

“Draco Lucius Malfoy, you have been determined for committing crimes most foul as a Death Eater…For the murder of Albus Dumbledore. You are here by sentenced to-”

“Just a moment Minister…” Draco snapped his head around at the stranger’s voice. ‘Potter!’ Harry continued. “Harry James Potter, serving as a witness to Draco Malfoy.” The minister scowled.

“Do you have proof of your being there… Mr. Potter?”

“If you would like a look at my memories then yes Minister, I believe I do. Draco Malfoy did not kill Albus. The professor and I had just returned from a journey to retrieve one of Lord Voldemort’s, oh please.” He said as many of the Wizengamot jumped. “One of his Horcuxes, when we found the dark mark hovering over the school. When we got to the top of the Astronomy Tower, seeing as I was already under my invisibility cloak, the professor petrified me when he heard someone approaching from behind.” Harry moved forward to stand at Draco’s side. Draco looked up and found Potter smiling down at him, so of course, he scowled.

“That still does not prove…”

“Please minister…” Harry interjected. “I was able to watch the entire proceeding that led to the Professor’s death. Draco went there under the threat that if he did not kill Albus than Voldemort would kill his parents. When he went to do the job Albus convinced him otherwise, convincing him that he could not kill in cold blood. When Severus Snape appeared, having made an Unbreakable Vow with Narcissa, he committed the act. I also have proof of memories that Severus was asked to kill Dumbledore, by the man himself, in and act of ‘helping an old man die’.”

At this point the Wizengamot erupted in a mass conversation, considering what has been revealed. Harry placed a hand on Draco’s shoulder. He could feel Malfoy trembling under his touch. Malfoy seemed frail there in the chains and dirty clothes. Harry felt pity for him but knew it would not be welcome so he kept his mouth shut. The noise of conversation died down and all eyes settled upon Draco once more.

“Have you come to a verdict?” Scrimgeour asked a witch that sat to his right.

“We have… Draco Lucius Malfoy, after much deliberation we are sentencing you to five years in Azkaban. On the charge-”

“No! I didn’t do anything” Draco cried out rising as far as he could. Several witches and wizards jumped at his outburst. “Please…” He pleaded sobs wracking his frail body.

“But I thought-” Harry began but the witch continued unhearing.

“Under the charge of conspiracy and attempted murder of Albus Dumbledore.” Draco’s cries doubled when the guards approached him. Harry’s stomach twisted at the sound of Draco’s torn voice. The Aurors gathered Draco and hauled him away.

“I’ll find a way to get you out… I know I will.” He called after them. Why did he want to help Malfoy so badly? What did it matter to him that he rotted in Azkaban? 'Because everyone deserves a second chance, Severus did. Why not Draco, he doesn’t deserve this.' A little voice murmured to him.
