HOGWARTS et al V. DRACO MALFOY

Author’s note: Let me start off by saying that I am studying human rights, and this idea popped into my head during class this morning. I wrote it today, and I wanted to give you a little bit of background before I start the story. **WARNING** ALL OF THE CHARACTERS (except Harry and Draco) ARE DARK, TWISTED, AND FUCKED UP!

International human rights is a HUGE field, but right now, I’m focusing on the courts. This is mostly modeled after the International Criminal Tribunals, with an aim towards emphasizing the inherent unfairness of the Iraqi Special Tribunal that was set up by the Americans to ‘try’ Saddam Hussein.

The regular tribunals aren’t as blatantly unfair as you are about to see this story become, but there is no question that the IST was. The “official” court document is different than most because most don’t give lists of witnesses and that sort of thing. Also, in international courts, there are no juries. It is either 1, 3, or 5 judges that render decisions, but the jury idea was too good to pass up.

Speaking of this jury, I feel like I have a relatively good sample of Draco’s ‘peers’ which include 4 adults and 8 students. There are also 8 Slytherins and 4 Gryffindors; 5 women and 7 men; 10 from Hogwarts; 3 Death Eaters; 4 Order members; and 2 Malfoy family members.

This trial is going to be, basically, unfair at every turn, even before it starts. They are all against Draco, and they change the rules to meet their needs, as you will see. For example, Draco is faulted for being a Death Eater, but the Prosecution is relying upon Death Eater testimony. Also, Tom Riddle/Voldemort sort of play a double role. “Tom Riddle” is the judge, and “Voldemort” (his alter-ego, if you will) is the bad guy, but as you will see, they are really trying to make Draco out to be the real bad guy.

When trying to decide where this fits in with the HP books…I’m not sure. Dumbledore isn’t dead, but Draco was assigned to kill him. The Final Battle occurred, and Voldemort did lose (because the Light had to prevail) but he wasn’t punished. I pretty much wanted to violate Draco’s human rights at every turn to make it so egregious and unfair (so hopefully you will be screaming right before the end) that the ending feels like so much more of a relief.

The format is a court transcript, with the italics being Draco’s thoughts/feelings/actions. If you have any questions or anything, as always, I am more than happy to hear them!

Prologue

Justice Riddle: Dumbledore, the Special British Wizarding Tribunal has been in place for about a month now. When are you going to bring a case before us?

Dumbledore: I am still working on my investigations, Tom. I have several likely candidates who need to be brought to justice.

Justice Riddle: Well, I’m ready to get going. What’s the easiest one you’ve got?

Dumbledore: Hmmm, that would probably be Voldemort.

Justice Riddle: No shit. Too easy…and his right hand Death Eater is still very powerful in political circles. Hey, what about his son? Did you see that blurb in the ‘Daily Prophet’ about the Malfoy men having a fight?

Dumbledore: I didn’t have to see it. Lucius came to me personally to ask about pressing charges against his son.

Justice Riddle: And you’ve been holding out on me? Really, Dumbledore.

Dumbledore: The accusations aren’t going to stand up in court, Tom.

Justice Riddle: So make some more up. Surely that little punk pissed off a lot of people.

Dumbledore: You know, you’re right. Okay, give me a week, and I’ll have a fantastic trial for you. I’ve got an idea, and you’ll get your first conviction.
