I've been reading your story and am enjoying it quite a bit. You're a good writer, and the story is pretty fantastic. Very interesting and not really like anything I've read before.
That being said, I just read this:
11/06: It has been brought to my attention that there is another fic bearing similarities to mine. I noticed it when I began posting my new story, Everything Counts and I have read it and would like to reassure readers that I am keeping an eye on its progression. I'm not too worried about plagiarism at this point though, we just had the same idea.
I had to laugh. You do realize that this is FAN FICTION you're writing, right? You have no business using the word plagiarism.
That being said, I just read this:

I couldn't really let that slide I'm afraid. Yes, this is fanfiction, hence the disclaimer, I do not own the characters or locations, they are the work of JKR I am not attempting to pass them off as my own creations. However, my words are my own, my plot, my OOC characters, my dialogue etc. are just that, mine. Plagiarism is a tricky thing, under the law it's complicated and often doesn't make it to court because you can't always prove that someone has directly taken another's work. In academia (my field) it is a common problem.
If you have another look at my author's note (the one you cited) you'll see that I said I wasn't too worried about it, I was simply responding to some reviews I'd had from concerned readers. The story in question was subsequently withdrawn by the author. It was pretty similar to mine and I did have some concerns that certain sections of dialogue and description were almost word for word like mine. Even if my story is fanfic, it is still plagiarism for someone else to copy and paste my words and publish them under the pretence of originality.

I did find it a bit disturbing, but that was only towards the very end of the flashback.. I'm old fashioned in certain things, but it hasn't turned me off the story in any way.
At least he still loves Hermione, and now DRACO KNOWS??? WHAT!!! This is going to ruin them for sure isn't it?

I agree. Whilst I agree that fanfiction is just light hearted fun, there are some things that should still be taken seriously, and whilst we are using someone else's characters we are still creating our own plots within that world and stealing plot, dialogue or settings is still wrong. Whatever the reason.
It still takes a lot of work to write a fanfiction, and it isn't right that someone else steals the plot.
